Namesake Monthly Giveaway Terms & Conditions  

Giveaway is now closed and no longer accepting entries.  

1. Sponsor: The Sponsor of the monthly giveaway is Namesake, 8500 Rex Road, Pico Rivera, CA 90660 USA
2. Eligibility: The monthly giveaway (the “sweepstakes”) is open to new users who sign up to be an email subscriber for Namesake. Users must be 18 years of age by date of entry. Users that are already subscribed to receive Namesake emails will not be eligible. Users that have previously been signed up for emails and resign up will also not be eligible. Employees, independent contractors, interns, officers, directors, and agents of Namesake (the "Sponsor") their respective affiliates, subsidiaries, advertising and promotion agencies, suppliers and their immediate family members and/or those living in the same household of each are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited.
3. Agreement to Rules: By participating, the contestant (“You”) agrees to be fully unconditionally bound by these rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of Namesake, as final and binding as it relates to the content. The giveaway is subject to all applicable federal, state and local laws.
4. Giveaway Period: Entries for each monthly giveaway will start at 12:00:00 a.m. PST on the 1st day of each month and end at 11:59:59 p.m. PST on the final day of each month. Entries submitted after the month deadline will be entered into next month’s giveaway
5. How to Enter: New users can enter the giveaway by signing up on namesakehome.com (Sign Up Here) to become an email subscriber and receive future emails from Namesake. Entries that are not complete, or do not ahere to rules or specifications may be disqualified at the sole discretion of Namesake. You must provide the information requested. Using fraudulent methods or other methods to circumvent the rules will result in your submission being removed at the sole discretion of Namesake (includes but not limited to, entering more times than indicated by using multiple email addresses, identities or devices). Namesake will not acknowledge receipt of entries. If you unsubscribe to receive future emails, your entry will automatically be removed from future prize drawings.

Entries will be collected for an entire month and the deadline to submit your email will end at 11:59:59 p.m. PST on the final day of the month. Entries not received by the deadlines below will be entered in the next month’s drawing. Non-winning entries will NOT be rolled over to the next month’s or any other future drawing.  The sponsor’s computer is the official time-keeping device for this promotion. 

6. Prizes: Winner will receive an online coupon code which is good for $1000 off the user’s order. Code is one-time use and the unused value will be forfeited and cannot be carried onto a future order. $1000 is only applicable to the item price, any and all prize related expenses, including without limitation to any and all federal, state, and/or local taxes, shipping and oversize fees, shall be the sole responsibility of the winner. Orders can only ship to an address within the contiguous 48 US states. The order cannot be shipped to Hawaii, Alaska or PO Box addresses

The specifics of the prize shall be solely determined by the Sponsor. No other cash or prize substitution is permitted except at the Sponsor’s discretion. Acceptance of the prize constitutes permission for Namesake to use the winner’s name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law. 

7. Odds: The odds of winning is dependent on the number of eligible entries received for each month
8. Winner selection and notification: Winners of the giveaway will be randomly selected from all eligible entries received. Winners will be notified via email to the email address they entered the giveaway with. Non-Winners will not be contacted. Namesake shall have no liability for a winner’s failure to receive notices due to winners’ spam, junk e-mail or other security settings or for winners’ provision of incorrect or otherwise non-functioning contact information. The selected winner must use the coupon code within 9 months of coupon being sent. If the selected winner is ineligible, the prize may be forfeited and an alternate winner selected.

The drawing date for the month’s winner will be completed on the 2nd Tuesday of the following month (Example. January’s giveaway winner will announced on the 2nd Tuesday of February). The winner will be notified by email with the prize code within five (5) business days of each drawing.  

The receipt by winner of the prize offered in this Sweepstakes is conditioned upon compliance with any and all federal and state laws and regulations. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE SWEEPSTAKES AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED. 

9. Rights Granted by you: By entering this content, you understand and agree that the Sponsor and anyone acting on behalf of the Sponsor or its respective licensees, successors, and assigns, shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the World, without limitation, your entry, name, portrait, picture, voice, likeness, image, statements about the Campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes without any further compensation, notice, review, or consent. By entering this content, you represent and warrant that your entry is an original work of authorship, and does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, you will be disqualified at the sole discretion of the Sponsor. If the content of your entry is claimed to constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless Namesake from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which Namesake may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.
10. Terms and Conditions: The sponsor reserves the right, in its sole discretion to cancel, terminate, modify or suspend the giveaway should (in its sole discretion) a virus, bug, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Sweepstakes. In such case, Namesake may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by Namesake. Namesake reserves the right at its sole discretion to disqualify any individual who tampers/attempts to tamper with the entry process or the operation of the giveaway or website or violates these Terms & Conditions. Namesake has the right, in its sole discretion, to maintain the integrity of the giveaway, to void entries for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by sweepstakes rules; or the use of bots, macros or scripts or other technical means for entering. Any attempt by an entrant to deliberately damage the web site or undermine the legitimate operation of the sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Namesake reserves the right to seek damages from any such person to the fullest extent permitted by law. By entering the giveaway, you agree to receive email newsletters periodically from Namesake. Limitation of Liability: Limitation of Liability: By entering the Sweepstakes you agree to release and hold harmless Namesake and its subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (i) such entrant’s participation in the Sweepstakes and/or his/her acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) unauthorized human intervention in any part of the Sweepstakes; (iii) electronic or human error in the administration of the Sweepstakes or the processing of entries; (iv) technical errors of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (v) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (vi) printing errors; (vii) lost, late, postage due, misdirected, or undeliverable mail.

13. Disputes: This Sweepstakes is governed by the laws of United States, without respect to conflict of law doctrines. By participating in this Campaign, you agree that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Campaign, shall be resolved individually, without resort to any form of class action, exclusively before a court located in United States having jurisdiction. Further, in any such dispute, under no circumstances shall You be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than actual out-of-pocket expenses (i.e. costs associated with entering the Sweepstakes). You further waives all rights to have damages multiplied or increased.
